08 Jul Should you get a “second opinion?”
Are you involved in a professional liability or insurance coverage matter where there is a disagreement or uncertainty within the members of your team? Do you see things a bit differently than the policyholder, other counsel, or insurance company representatives involved in the matter? Or, are the parties to the dispute just “stuck” as they advocate their respective positions and continue to disagree regarding certain key aspects of the matter? Often, it can be just one – or perhaps a few – key issues that are the root cause of the hang up. Consider obtaining a “second opinion” to challenge your thinking and conclusions or to help build confidence and consensus within the members of your team. By asking a trusted advisor with relevant and respected experience and expertise in the subject matter of the dispute to take a look at the key issue(s) about which stakeholders disagree, you often can find a path to break through the barrier to building team consensus or to achieving resolution with the other parties.
